Terms & conditions

These terms apply when you buy something on customk.co, order a Made for You piece (a commission) or buy a gift card from me. If anything is unclear, just ask before you order. Nothing here takes away the rights you have as a consumer under the law.

1. Who you're buying from

Custom K is my registered craft business (obrt) in Croatia. I'm Karmela Josipović, and I paint every piece myself.

2. What I sell

• Shop pieces are my own designs, hand-painted on new sneakers and jackets. A design isn't a numbered edition: I can paint it again on request until I retire it (then it's closed for good). Every piece is still painted by hand, one at a time, so no two are exactly alike. A size is either in stock (ready to ship: already painted, ships within 1–3 working days) or painted to order (there's no stock yet: after you order, I get a fresh, new blank in your size and paint the design on it; the current waiting time is shown on the product page, and the expected delivery dates at checkout, before you pay). If I can't get the blank in your size after all, I tell you straight away and you get a full refund.
• Personalised pieces: where a design offers it, you can add something of your own, like your name, initials, your own text or your own colours. I send you a mock-up to approve before I paint. Personalisation is always optional.
• Made for You (commissions) are pieces painted to your own idea. You send me a brief through the Made for You wizard, I reply and we talk it through by email. Then I send you my offer: the design and the item I'd paint it on. Once you like it, I send you a quote with the price, the expected timing and a payment link. Nothing is owed by either of us until you pay the quote. Photos and drawings you upload are only references for me: I paint my own take, not a copy. Please only send photos you're allowed to share.
• Painting your own item is a service I offer only by agreement: you send me your own sneakers or jacket and I paint them. The item must be new (unworn): I don't do repairs or restorations (yet). I prefer to work with the models I know (such as Nike Air Force 1, Air Jordan 1 High or Low, or a denim jacket), but I'm happy to look at anything. I'll confirm your item before you post it. Sending it to me is at your cost and your risk until it arrives with me.
• Gift cards for the shop and Made for You, delivered by email (see 7).

Every piece is painted by hand, so small differences from the photos, like brush marks or slight shifts in colour, are part of the piece and not a fault. Screens also show colours a little differently.

Nike, Adidas, Vans, Converse and Diverge are trademarks of their respective owners. Custom K is not affiliated with or endorsed by them. Products are customised by hand after purchase.

3. Prices and payment

• Prices are in euros (€) and are final. I'm not in the VAT system, so no VAT is added.
• Shipping is shown in the cart and at checkout before you pay. See Shipping for rates.
• You pay the full amount when you order. Payments are processed securely by Stripe; I never see your card details.
• You can pay for an order or a Made for You quote, in full or in part, with a gift card (see 7).
• Discount codes: now and then I give out a code, for example to newsletter subscribers. You enter it in the cart or on a Made for You quote's payment page, before you pay; it can't be added afterwards. Each code has its own conditions, shown when I give it out: what it's for (everything, certain pieces or Made for You), a minimum amount, how long it runs and how often it can be used. Some codes can be used once per email address, and some only by newsletter subscribers: for those, enter the email you subscribed with. A code comes off the pieces, never the shipping, and it can't make an order completely free or be exchanged for cash. A Made for You quote that already has a discount of its own doesn't take a code. You can use a code together with a gift card: the code comes off first, and the gift card pays for what's left. If an order paid with a code is cancelled or refunded, you get back what you actually paid; the code isn't given back.

4. How an order works

• Shop: choose a design and size, check the summary at checkout (items, sizes, delivery times, total) and pay. Our contract is made when you receive my order confirmation by email.
• Personalised pieces: as for the shop, plus your personalisation. After you order, I send you a mock-up. If we can't agree on it, I cancel the order and refund you in full.
• Made for You: sending a brief costs nothing and commits you to nothing. Our contract is made when you pay my quote. The quote says what I'll paint, on which item, the price and the expected timing.
• Your own item: as for Made for You, our contract is made when you pay the quote. Once I've confirmed your item, I'll send you the address by email. Please don't send anything before that.

If something goes wrong with an order, for example the last in-stock size sold at the same moment, I can't get the blank for a size painted to order, or a price was obviously wrong, I'll contact you straight away. If you don't want to go ahead, or I can't make it, you get a full refund.

5. Delivery

• I ship to Croatia and every other EU country. Rates and delivery times are on the Shipping page.
• Every parcel is tracked and insured, and you get the tracking number by email.
• Your piece is my responsibility until it's delivered to you. If it arrives damaged, email me photos of the piece and the packaging, and I'll repair it, replace it or refund you.
• Checkout and your order confirmation show when your order should ship and arrive. If I can't deliver in the time stated, I'll let you know. If it still doesn't arrive within an extra period we agree on, you can cancel and get a full refund.

6. Your right to withdraw

Whether you can withdraw depends on how you buy:

• Shop pieces, in stock or painted to order: yes, within 14 days of delivery, without giving a reason.
• Personalised pieces: no, once you've approved the mock-up.
• Made for You (commissions): no.
• Painting your own item: yes, within 14 days of paying the quote, until the painting is finished.
• Gift cards: yes, within 14 days of buying, as long as the card hasn't been used (see 7).

None of this affects your rights if a piece is faulty or not as agreed (see 8).

Shop pieces (in stock and painted to order). If you choose only a design and a size, you can withdraw within 14 days without giving a reason. This includes sizes I paint after you order: they're still my design in a standard size. The 14 days start on the day you (or someone you name, other than the carrier) receive the piece, and you can also withdraw before it arrives.

• To withdraw, tell me before the 14 days are over, for example by email to [email protected]. You can use the model form below, but you don't have to.
• Send the piece back within 14 days of telling me, to the address I give you. You pay the direct cost of returning it.
• I refund everything you paid, including the standard shipping, within 14 days of receiving your withdrawal, using the same payment method and at no cost to you. I can wait with the refund until the piece is back with me or you've shown me you've sent it, whichever comes first.
• Please try the piece on indoors only, like you would in a shop, and don't wear it outside. If it's been worn or damaged, I may deduct the loss in value.

Personalised pieces. Once you approve the mock-up, the piece is made to your specifications, so the right of withdrawal doesn't apply (Art. 86 of the Croatian Consumer Protection Act). I'll ask you to confirm this with a separate tick box before you pay. If we can't agree on the mock-up, you get a full refund. You can always buy the same design without personalisation and keep your 14 days.

Made for You (commissions). A Made for You piece is painted to your own idea and specifications, agreed by email, so the right of withdrawal doesn't apply once you pay the quote, even before I start painting. The quote says this before you pay.

Painting your own item. This is a service, so you can withdraw within 14 days of paying the quote. I'll only start painting within those 14 days if you ask me to and confirm that you understand that:

• if you withdraw after I've started, you pay for the work done up to then, and
• once the painting is finished, you can no longer withdraw.

I'll confirm your request by email before I start.

7. Gift cards

The Made for You gift card is a code worth an amount in euros, to spend at Custom K. It works like this:

• Amounts: €50, €100 or €200, or your own amount from €25 to €500.
• Delivery: by email, to you or straight to the recipient on the date you choose, with a printable card.
• Validity: 24 months from the day it's issued. The expiry date is on the card.
• What it pays for: anything in the shop and Made for You quotes, in one go or over several orders until the balance is used up. It doesn't cover shipping.
• One per order: you can use one gift card per order. It can be combined with a discount code: the code comes off first, and the gift card pays for what's left.
• No cash: a gift card can't be exchanged for cash and I don't give change. Whatever is left stays on the card for next time.
• Keep the code safe: whoever has the code can spend it, so treat it like cash. If it gets lost, I can resend it to the email address of the person who bought it.
• Changed your mind: you can cancel an unused gift card within 14 days of buying it and get a full refund. Just email [email protected].
• If I can't deliver: if an order or quote paid with a gift card is cancelled or refunded, the gift card amount goes back onto the card. Any part you paid by card is refunded to your card under the usual refund rules.
• VAT: Not in the VAT system: VAT is not charged under Art. 90(1) of the Croatian VAT Act. That applies to gift cards just like everything else I sell.
• Availability: gift cards may sometimes not be on sale; the gift card page says so when they aren't. Cards already issued stay valid and can be spent as usual.

8. Faults, complaints and disputes

Every piece is checked before it's packed. If a piece is faulty, you're protected by the legal guarantee of conformity for 2 years from delivery: I'll repair or replace it, or if that isn't possible, give you a partial or full refund. Please tell me as soon as you notice the fault.

Normal wear isn't a fault: like any art you wear, painted sneakers can scuff in everyday use. See the care tips in the FAQ.

Complaints: send them in writing by email to [email protected] or by post to Zorkovačka ulica 2, 10000 Zagreb, Croatia. I'll confirm I've received your complaint straight away and reply in writing within 15 days.

Out-of-court dispute resolution: if we can't sort it out together, you can turn to the Court of Honour of the Croatian Chamber of Trades and Crafts (Sud časti HOK), which also offers mediation and is free for consumers: hok.hr, Ilica 49/II, 10000 Zagreb. If you live in another EU country, the European Consumer Centre in your country can also help for free.

9. Designs and photos

All designs, photos and texts on this site are mine. Buying a piece gives you the piece, not the right to copy the design or use the photos commercially. I may photograph Made for You pieces and show them in the gallery and on social media; if you'd rather I didn't, tell me when you order. Photos you send me stay yours: I only use them to paint your piece.

10. Law and changes

These terms are governed by Croatian law. If you're a consumer living in another country, you keep the protection of the mandatory consumer law of your country. I may update these terms; the version on the site when you ordered applies to your order.
